Pentagon programs target of China cyber threat

(AP) ? New revelations that China used cyberattacks to access data from nearly 40 Pentagon weapons programs and almost 30 other defense technologies have increased pressure on U.S. leaders to take more strident action against Beijing to stem the persistent breaches.

The disclosure, which was included in a Defense Science Board report released earlier this year, but is only now being discussed publicly, comes as Defense Secretary Chuck Hagel heads to Southeast Asia, where he will discuss the escalating cyberthreat with counterparts from a number of area nations.

While officials have been warning for years about China's cyber espionage efforts aimed at U.S. military and high-tech programs, the breadth of the list underscored how routine the attacks have become. And, as the U.S. looks to grow its military presence in the Asia Pacific, it heightens worries that China can use the information to blunt America's military superiority and keep pace with emerging technologies.

"It introduces uncertainty on how well the weapons may work, and it means we may have to redo weapons systems," said James Lewis, a cybersecurity expert at the Center for Strategic and International Studies. "If they know how it works precisely, they will be able to evade it and figure out how to better beat our systems."

A chart included in the science board's report laid out what it called a partial list of 37 breached programs, which included the Terminal High Altitude Area Defense weapon ? a land-based missile defense system that was recently deployed to Guam to help counter the North Korean threat. Other programs include the F-35 Joint Strike Fighter, the F-22 Raptor fighter jet, and the hybrid MV-22 Osprey, which can take off and land like a helicopter and fly like an airplane.

The report also listed another 29 broader defense technologies that have been compromised, including drone video systems and high-tech avionics. The information was gathered more than two years ago, so some of the data is dated and a few of the breaches ? such as the F-35 ? had actually already become public.

The details of the breaches were first reported by The Washington Post.

According to a defense official, the report is based on more than 50 briefings that members of the board's task force received from senior leaders in the Pentagon, the State Department, the intelligence community, national laboratories and business. The official was not authorized to discuss the report publicly so spoke on condition of anonymity.

U.S. officials have been far more open about discussing the China cyberattacks over the past year or two, beginning with a November 2011 report by U.S. intelligence agencies that accused China of systematically stealing American high-tech data for its own national economic gain. The Pentagon, meanwhile, in its latest report on China's military power, asserted publicly for the first time that Beijing's military was likely behind computer-based attacks targeting federal agencies.

"In 2012, numerous computer systems around the world, including those owned by the U.S. government, continued to be targeted for intrusions, some of which appear to be attributable directly to the Chinese government and military," said the report, which was released earlier this month.

In Beijing on Wednesday, Assistant Foreign Minister Zheng Zeguang did not directly address the allegations, but said that China opposes all hacking and referred to an agreement with the U.S. to form a cybercrime working group.

Cybersecurity experts have for some time been urging the U.S. government to use sanctions or other punishments against China for the breaches.

The benefits to the cyber espionage are high and the costs are low, said Shawn Henry, former cyber director at the FBI and now president of CrowdStrike Services, a security technology company.

"There is no cost, there are no sanctions, no diplomatic actions, no financial disincentives," said Henry, adding that the U.S. intellectual property losses are in the hundreds of millions of dollars. He said that the U.S. needs to have a discussion with Chinese leaders about "what the red lines are and what the repercussions will be for crossing those red lines."

U.S. leaders, including President Barack Obama, however, have instead been using the bully pulpit to increase pressure on the Chinese to confront the problem. Obama is expected to raise the issue with China's new leader Xi Jinping during a summit next month in Southern California.

Pentagon Press Secretary George Little said Tuesday that the Pentagon maintains "full confidence in our weapons platforms," adding that the department has taken a number of steps to strengthen its network defenses and monitor for threats.

Defense contractors, meanwhile, declined to say whether their systems had been breached. But recent filings to shareholders indicate these companies see intrusions as a serious risk to their business, particularly when they must rely on third-party suppliers.

In its most recent annual report, Lockheed Martin ? a primary contractor on missile defense programs ? told shareholders that prior cyberattacks "have not had a material impact on our financial results," and that it believed its security efforts were adequate.

However, suppliers and subcontractors have "varying levels of cybersecurity expertise and safeguards and their relationships with government contractors, such as Lockheed Martin may increase the likelihood that they are targeted by the same cyber threats we face," according to the 2012 report.

In a statement emailed to reporters on Tuesday, Lockheed Martin said it has made "significant investments" in cybersecurity and that the company was trying to secure its supply chain given that "program information resides in a large cyber ecosystem."

Similar risk disclosures to shareholders have been made recently by Northrop Grumman, Boeing and Raytheon. For example, Northrop Grumman wrote in its 2012 annual report that cyber intrusions "could damage our reputation and lead to financial losses from remedial actions, loss of business or potential liability."

Company spokesman Randy Belote on Tuesday declined to say whether Northrop Grumman's systems had been breached, citing company policy. But, he added, "the number of attempts to breach our networks (is) increasing at an alarming rate."

Mich. House OKs spending plan, boost for schools

LANSING, Mich. (AP) -- The Republican-controlled Michigan House approved a $49 billion spending plan on Tuesday that would put $15.1 billion toward education and boost funding for state universities, community colleges and public schools, but possibly halt the implementation of new learning standards in public schools.

The budget bills for fiscal year starting Oct. 1 now head to the Senate for final approval before they head to Republican Gov. Rick Snyder.

Some House Democrats attacked the spending plan, saying it didn't do enough to correct past cuts to the state's education system and could hurt Michigan students by putting funding for the Common Core State Standards at risk.

"This budget is only passable ? and I mean acceptable ? if you buy into the concept or the new paradigm that the Snyder administration has put in that we should have diminished expectations for public school funding," said Democratic Rep. Brandon Dillon of Grand Rapids.

Under the plan, Michigan's 15 public universities would receive about $31.1 million or 2 percent more in overall funding next fiscal year but would be expected to keep tuition rate increases at or below 3.75 percent to get some money that is tied to performance, such as the number of completed degrees.

Republican Rep. Al Pscholka of Stevensville said restraining tuition increases will help make college education more affordable, "which is good for students and families."

Michigan's public schools would get slightly more than 3 percent more in overall funding next year, including $140 million from a pot of nearly $700 million in extra funding that the state has thanks to better-than-expected tax collections.

School districts that now get the minimum amount of state aid could get as much as $60 more per student, raising the per-pupil grant from $6,966 to $7,026. The actual amount each district gets is determined by a number of factors, including whether a district meets "best practices" incentives, such as providing online learning opportunities for students. But the budget includes $6 million to ensure that all districts see at least a $5 per-pupil boost.

Republicans touted the increase in education funding, but Democratic Rep. Sam Singh of East Lansing said the state's universities are still worse off than where they were before the state cut their funding cut by 15 percent in 2011. Singh criticized the Legislature for not putting any of the surplus money toward higher education institutions, the "economic engines of our communities and our state."

Meanwhile, language included in Department of Education budget that was passed Tuesday would require the Legislature to affirm the Common Core State Standards ? benchmarks in reading, writing and math currently being adopted in Michigan's schools ? and the assessment that goes along with them or the department could use any funding to implement the standards.

The standards were developed by the National Governors Association and Council of Chief State School Officers and are backed by Snyder's administration. They aim to provide clear goals for teachers and allow for educational cooperation and comparison among states. But some Michigan lawmakers say they strip away local control of the state's educational system.

State Superintendent Mike Flanagan attacked the budget proposal, calling it a "legislative mandate to go backwards."

"When will they stop playing politics with our children's education?" Flanagan said in a statement. "Thoughtful improvements to education must be protected from partisan and self-serving politics, where adults should be more concerned about student needs rather than their own."

But House Republicans said the Legislature needs to take a breath before rushing into the new learning benchmarks.

"The education of Michigan's kids deserves the Legislature taking time to evaluate accountability standards," Ari Adler, spokesman for House Speaker Jase Bolger, said in an email. He said the Legislature will have plenty of time to act before the funding change takes place Oct. 1.

Other highlights in the spending plan approved Tuesday include:

? MEDICAID EXPANSION: The budget does not include expanding Medicaid to low-income Michigan residents, but that doesn't mean the expansion is off the table yet. Lawmakers are still considering a proposal to cap benefits for able-bodied adults at 48 months and funding for the expansion could be added to the budget later.

? EARLY CHILDHOOD: A preschool program for 4-year-olds at risk of failing will get a $65 million boost next fiscal year, which Snyder had called for in his budget proposal in February.

? REVENUE SHARING: County revenue sharing would increase by more than $12 million or about 4.8 percent. The Michigan Municipal League said the funding boost begins the process of restoring more than a decade of cuts to local revenue sharing, totaling more than $6 billion in the last 12 years.

? FILM INCENTIVES: The state's film incentive program will remain capped at $50 million. Snyder had proposed reducing the cap to $25 million next fiscal year, but lawmakers worked to keep it at its current funding level.

Rescuers save newborn from sewer pipe in China

BEIJING (AP) ? A newborn boy is recovering in a Chinese hospital after being rescued from a sewage pipe below a squat toilet by firefighters, who sawed off an L-shaped section and then delicately dismantled it to free the trapped baby.

A tenant heard the baby's cries in the public restroom of a residential building in Zhejiang province in eastern China on Saturday and notified authorities, according to the state-run news site Zhejiang News. A video of the two-hour rescue that followed was broadcast widely on Chinese news programs and websites late Monday and Tuesday.

The child ? named Baby No. 59 from the number of his hospital incubator ? was reported safe in a nearby hospital, and news of the rescue prompted an outpouring from strangers who came to the hospital with diapers, baby clothes, powdered milk and offers to adopt the child.

The baby weighed 2.8 kilograms (6.2 pounds) and still had his placenta attached to his body, reports said. His heart rate was low and there were grazes on his head and limbs, but he was largely unscathed, according to Zhejiang Online, the province's official news portal.

It was not immediately clear how the baby ended up in the toilet, but police said they were treating the case as an attempted homicide. The Pujiang county police bureau said on its official microblog account that the boy's mother has been located and that an investigation is ongoing, but gave no further details.

A duty officer at the Pujiang Public Security Bureau reached by phone late Tuesday said he had no information and that staffers involved in the investigation had left for the day.

On China's popular Twitter-like microblogs, some users expressed pity for the child and horror at his ordeal. Most bloggers speculated that the child had been abandoned and dumped by his parents down the toilet.

The landlord of the building in Pujiang county told Zhejiang News that it was unlikely the birth took place in the restroom because there was no evidence of blood and she was not aware of any recent pregnancies among her tenants.

The baby was stuck in an L-shaped portion of the sewage pipe with a diameter of about 10 centimeters (3 inches).

The video shows rescuers sawing off a section of the pipe along a ceiling that apparently was just below the restroom. The rescuers then rushed that section of pipe to a hospital, where firefighters and medics alternately used pliers and saws to rip apart the pipe and free the baby.

Despites the offers to adopt Baby No. 59, a doctor at the hospital said the boy would be handed over to social services if his parents did not claim him, Zhejiang News said.

In China, reports of babies being abandoned are common and fuel public anger against a strict one-child policy that imposes huge fines on parents who violate the rules. The policy has been blamed as a factor causing parents to abandon unwanted children, though they are usually baby girls whose parents want sons due to a traditional preference for male heirs.

More than a dozen die in Iraq bombings

BAGHDAD (AP) ? Bombings and gunfire in central and northern Iraq killed at least 15 people and wounded 35 others on Tuesday, officials said, in the latest bloody chapter of a wave of violence that has edged the country closer to all-out internal warfare.

A day earlier, 70 people were killed, and more than 450 have died this month. Most of the attacks are sectarian in nature, with Sunni and Shiite areas targeted frequently.

The sudden spike in bloodshed is reminiscent of the upheavals of the last decade, when U.S. forces were still in Iraq in large numbers. The sectarian carnage has resumed with new ferocity since the last U.S. troops withdrew last December.

Tuesday's violence spread across the country.

A bomb explosion inside a bus killed five commuters in Sadr City, a poor Shiite district in the Baghdad's east, a police officer said. Five policemen and 20 civilians were wounded.

In the town of Tarmiyah north of Baghdad, a suicide bomber set off his explosives-laden truck after passing a police checkpoint, killing a policeman and a civilian, police said. Nine people were wounded.

In the northern city of Mosul, clashes erupted out between police and gunmen, killing three policemen, two officers said. Four gunmen were killed and 15 others arrested. South of Mosul, a bomb hit a police patrol, killing an officer and wounding another, police said.

Mosul, about 360 kilometers (220 miles) northwest of Baghdad, is a former stronghold of Sunni militants.

Three medical officials confirmed the casualties. All spoke on condition of anonymity as they were not authorized to release information to reporters.

No one has claimed responsibility for the recent wave of attacks, but such systematic bombings bear the hallmarks of Sunni insurgents under the leadership of the al-Qaida branch in Iraq, known as the Islamic State of Iraq. They appear aimed at drawing the country's majority Shiites into an exchange of attacks like that which brought the country to the brink of civil war in 2006-2007.

On Monday, more than a dozen car bombs hit commercial areas in mostly Shiite areas of the Iraqi capital, killing 71 people and wounding nearly 200.

Iraqi Prime Minister Nouri al-Maliki charged that the motive behind the current flare-up was to return Iraq to the "dark days" of the past decade. He vowed to hunt down all militant groups, regardless of their religious and political affiliations.

"The recent attacks that killed dozens of innocents expose the criminal intentions and the goals of the terrorist organizations to send Iraq back to sectarian fighting," al-Maliki told reporters in Baghdad.

On Tuesday, U.N. envoy Martin Kobler pressed Iraqi leaders to do more to halt the violence, saying it is "their responsibility to stop the bloodshed now."

Kobler has repeatedly urged Iraqi officials to engage in dialogue as violence and political tensions have increased in recent weeks.

He warned political leaders Tuesday that "the country will slide into a dangerous unknown if they do not take immediate action."

All of this raises a big question: What were our apelike ancestors thinking when they started walking upright??

A prevailing hypothesis is that they were prompted by climate change. As African forests declined due to?temperature?fluctuations some 2.5 million years ago, the hypothesis?goes, our australopithecine ancestors descended from the trees and ventured out into the open savanna, an environment thought to be friendlier for those standing on two feet.?

The savanna hypothesis has its critics, however. There is some evidence that bipedal primates evolved before the biggest temperature swings kicked in, that some australopithecines ancestors lived in forests, and that they were adapted to both tree-climbing and upright walking. ?

Now a new study suggests that walking on two legs was a result of geology, not climate. In a study published in this month's issue of the archaeological journal Antiquity, a team of archaeologists makes the case that our forebears' transition to bipedalism was?prompted by volcanoes and shifting tectonic plates in East and South Africa, which produced rocky outcroppings and steep gorges.

?The broken, disrupted terrain offered benefits for hominins in terms of security and food, but it also proved a motivation to improve their locomotor skills by climbing, balancing, scrambling and moving swiftly over broken ground - types of movement encouraging a more upright gait,? said University of York archaeologist and study co-author?Isabelle Winder, in a press release.

This development would have conferred benefits that extend far beyond locomotion. Walking on two legs frees up the hands, allowing for the use of tools and, eventually, bigger brains. And the complex landscape could have made our ancestors smarter, says Dr. Winder.

?The varied terrain may also have contributed to improved cognitive skills such as navigation and communication abilities, accounting for the continued evolution of our brains and social functions such as co-operation and team work."

Jazz drummer Ed Shaughnessy, who played a major role in Doc Severinsen's "Tonight Show" band from 1963 to 1992, has died at age 84.

Shaughnessy died of a heart attack Friday at his Calabasas, Calif. home, the Los Angeles Times reports.

He began drumming as a teen and performed with such famous names as Billie Holiday, Aretha Franklin and Jimi Hendrix.

His big band experience included work with the Benny Goodman, Count Basie and Tommy Dorsey bands.

Doc Severinsen's memoir, quoted by the Times, calls Shaughnessy, "the superb engine that drove our Tonight Show Band for thirty years ? with spirit and immense skill."

Many "Tonight Show" viewers learned to recognize Shaughnessy by his distinctive muttonchop whiskers.

He is survived by a son, daughter-in-law, and three grandchildren, the Times reports. His wife Ilene Woods, who died in 2010, provided the voice of Cinderella in Disney's 1950 animated classic film.

After Maoist massacre in India, fear of worse to come

A massacre by Maoist guerrillas in eastern India that killed 29 people Saturday placed a spotlight on the group's insurgency and ignited fears of more violence heading into an election.

Among the victims of the attack were senior leaders of India's Congress party in the eastern state of Chattisgarh and Prime Minister Manmohan Singh indicated the government will step up its offensive against the Maoists. "We have to be more determined in fighting Naxal (Maoist) extremism. These lives should not go in vain. This incident should be treated as an inspiration in our fight against forces of extremism and violence," he said. The attack occurred in the Darbha Valley in the Bastar plateau of Chattisgarh. The Communist Party of India (Maoist), whose members are also known as Naxalites, controls large parts of territory in the tribal-dominated Bastar region. On Saturday, a group of 250 guerrillas ambushed a convoy of 25 cars carrying leaders and workers of the Congress party. The convoy was part of voter mobilization for the state elections due in October.

The chief target in Saturday's attack was a tribal leader, Mahendra Karma, who in 2005 had founded a state-supported anti-Maoist militia known as the "Salwa Judum" meaning "Peace March" which has been criticized for human rights violations and hiring child soldiers. The Supreme Court of India disbanded the Salwa Judum in 2011, calling it unconstitutional.

"Since the disbanding of the Salwa Judum, Karma had become a symbolic target whom they had tried to kill before as well," says documentary filmmaker Sanjay Kak, whose recently released film, Red Ant Dream, shows damning footage of Karma organizing the Salwa Judum militia, contrary to his claims that it was a spontaneous Gandhian rebellion against the Maoists.

An eyewitness claimed that the guerrillas danced over Karma's body after spraying him with bullets. The attack also killed the state chief of the Congress party and his son, and critically wounded a senior central-level Congress leader, VC Shukla. The Congress party's national president, Sonia Gandhi, called it "a cowardly act" and "an attack on democratic values".

Sociologist Nandini Sundar, one of the petitioners against the Salwa Judum, says this was a massive security failure on the part of the government. "The government should have expected a response like this to their increased offensive against the Maoists in recent weeks," she says. On Mahendra Karma, she says, "If India had democratic values he would have been behind bars."

Anticipating an escalation of violence from both sides in the months ahead, Sundar said it would be "disastrous for villagers and the government should exercise caution."

Security analysts, however, are calling for an expanded military offensive against the Maoists, who are present to varying degrees in the forests of eastern India through what is called the "red corridor," spanning a third of India's 600 districts.

"The government's own data shows the Maoists have been busy consolidating their hold with arms and tribal mobilization," says Ajai Sahni, director of the Institute for Conflict Management in Delhi. "Casualties have reduced because the government hasn't been going on an offensive and the absence of violence made the government under-estimate the threat," he says.

Yankees' Teixeira to play in minors on Wednesday

TAMPA, Fla. (AP) ? Yankees first baseman Mark Teixeira expects to play in his first game since hurting his right wrist in early March, suiting up for a minor-league game with Double-A Trenton on Wednesday.

Teixeira, who injured the wrist while preparing with the U.S. team for the World Baseball Classic, has been working out at the Yankees' minor-league complex.

"If everything goes as planned, I'll leave here Tuesday and play in Trenton Wednesday and Thursday," Teixeira said Friday. "That's the plan right now."

With Yankees manager Joe Girardi watching, the All-Star took part in an extensive simulated game with infielder Kevin Youkilis, who is out with a sore back. Along with hitting and base running, the pair played defense between at-bats.

"That was a serious simulated game," Teixeira said. "That was challenging. It was good. It's hot here. We got a lot of good work done."

Teixeira may be ready to rejoin the Yankees in early June. Youkilis looks to start a minor-league rehab assignment soon.

Reliever Joba Chamberlain, sidelined by a right oblique strain, said he is scheduled to throw two innings out of the bullpen Saturday in his second extended spring training game.

"Everything feels good," Chamberlain said. "Continue to build up strength."

New York may not decide on the next step for Chamberlain until finding out how he feels on Sunday.

The Yankees are in Florida for a three-day weekend series against the Tampa Bay Rays.

Sure, the disc is dead. Technophiles love to say something or other is "dead." Funny, I still frequently see a lot of people reading "books" actually printed on paper. Anyway, in case you haven't heard about the death of the optical disc and still need or want to play a DVD or Blu-ray on your PC, you could do far worse than ArcSoft's TotalMedia Theatre 6. Though not quite as feature-laden as CyberLink's PowerDVD Ultra 13 (4.5 stars), it handled the media I tested it with more aplomb than Corel's WinDVD Pro 11 (2.5 stars) did, for the most part, and sported the simplest user interface of the lot.

Setup
TotalMedia Theatre is a quicker, smaller download file if you're getting it via the Web, at just 80MB. It runs on Windows 8, 7, Vista, and XP. You can try it out as a full-featured 15-day trial. It installed in just 2 minutes on my test PC, a Lenovo G580 laptop with 4GB RAM and integrated Intel HD Graphics 4000 running Windows 8. I had to allow it past my software firewall during installation, since it can act as a media server.

The setup also requires a reboot, but I was refreshed to find out that it didn't try to install irrelevant third-party software such as browser toolbars, as some competitors do. If you install the trial version, you can simply buy a serial number and activate?much easier than CyberLink PowerDirector, which makes you uninstall the trial and reinstall the full app.

Interface
Even though it's a desktop application that runs on all recent flavors of Windows, TotalMedia Theatre looks and feels like a Windows 8 app, especially since it runs in borderless full screen by default. This can actually make things a little confusing, since the app doesn't show up in the Windows 8 running app list. I also noticed that other apps couldn't show their windows when TotalMedia was in full screen?even after switching to the second app.

Playing Blu-ray
When I first popped in a Blu-ray movie, a Windows 8 like message bar across the screen informed me that the content didn't support the use of a mouse, and would I like to enable the ArcSoft Mouse Solution? Yes, thank you! This adds a remote-like control pad to the screen, which you could click to move back and forth in the movie menu. The software played my Blu-ray edition of The Big Year in glorious HD without breaking a sweat.

I could search TMDB?TotalMedia database. I could even use unpinch gestures to zoom in! The software also offers a slew of keyboard shortcuts, some for actions for which I couldn?t find on-screen menu equivalents.?

DVD Enhancements
The main enhancement for DVD playback is SimHD. This is controlled by a single switch from a Settings panel with just two choices: On and Off. The feature really did improve the quality of DVD playback?it was somewhat sharper and better lit and more contrast-y. I would, however, have liked to be able to adjust the strength of this effect, as the sharpening at times looked harsh.?

Playing 3D
TotalMedia Theatre played my test 3D Blu-ray movie, Fascination Coral Reef, using an Nvidia 3D Vision technology without the slightest complaint. Corel WinDVD wouldn't play it at all, and PowerDVD warned me that it could only play in full screen. It also did a tolerable job of converting a 2D DVD to 3D.

Playing Video Files
First for a disappointment: One thing the software wouldn't play was
4K video clips from a GoPro Hero3 Black Edition camcorder. It does, however, play quite a lot of file formats, though, including AVCHD,WMV, MPEG, AVI, and more. MKV and AVS are new additions for version 6.

I could not rotate my upside-down iPhone video with TotalMedia Theatre. PowerDVD graciously (and easily) let me do this. But the ArcSoft software did play that HD video from my iPhone with less waiting than PowerDVD did.

Mobile's Little Helpers
Though it doesn't offer the kind of app possibilities you get with PowerDVD, there are iOS and Android apps to use those devices as remote controls?something very useful if you're using the software on a home-theater PC. And setup for the ArcSoft app was miles simpler than with the PowerDVD setup. Basically, there was no setup, it just worked. The app has two pages, the basic remote fast forward, reverse, next chapter, and so on, and an arrow key plus center enter button page. The large buttons made couch-potatoing a snap; I could change the volume, and red power button even lets you shut down and turn on the PC application.?

Performance
TotalMedia Theatre can take advantage of Nvidia CUDA parallel computing architecture and OpenCL for AMD processors. I foundprogram response and playback snappy, and didn't run into any program crashes or failures to respond.

Let's Go to the Theatre?Or Stay!
If you're looking for a super simple way to play DVD, Blu-ray, and other video content on your Windows PC, you could do a lot worse than ArcSoft TotalMedia Theatre. It handles any of the 3D and other type of video content you're likely to play. The interface is super simple, though you may confuse it with a new-style Windows 8 app. The software's mobile remote control app was a snap to set up and easy to control playback with from the couch. If you're a real video aficionado, though, you'll want our Editors' Choice, CyberLink PowerDVD 13 Ultra, which offers more playback options and streaming playback to and from mobile devices.

Canada's privacy laws inadequate for digital age, watchdog says

Canadians' trust in the digital economy is at risk because our laws don't have enough teeth to compel companies to protect consumers' privacy, Canada's privacy commissioner says.

"It is increasingly clear that the law is not up to the task of meeting the challenges of today ? and certainly not those of tomorrow,? Jennifer Stoddart said Thursday when she released a report recommending changes to Canadian privacy legislation governing the private sector.

"The legislation lacks mechanisms strong enough to ensure organizations invest appropriately in privacy. As a result, consumer trust in the digital economy is at risk.?

Speaking to members of the International Association of Privacy Professionals at their annual Canada Privacy Symposium, where she released her position paper, Stoddart noted that technological advances have massively expanded the scale of personal information that organizations can collect, store and use as they create new products and services. Sometimes, she added, that occurs in ways that are intrusive, or without the genuine consent of the individuals that the personal information belongs to.

Stoddart has previously complained that many companies, such as social media websites, routinely ignore Canadian privacy laws.

She said Thursday that other countries have already made changes to their privacy laws to address the challenges posed by new technology and it is important that Canadian legislation "evolve to keep up with the rest of the world."

In order to address such issues, Canada's Personal Information Protection and Electronic Documents Act (PIPEDA) must be beefed up to include stronger enforcement, she added.

"Right now, the only real power I have is to name [companies that break the law]," she said. "This provides Canadians with information about where they may ? or may not ? wish to take their business. But how can Canadians vote with their feet when increasing amounts of their personal information are being held by fewer and fewer organizations?"

Stoddart's paper recommends expanding enforcement powers under the law to allow for:

  • Financial penalties such as compensation for damages, administered by the Federal Court or fines imposed by the privacy commissioner.
  • The privacy commissioner to make orders that companies must comply with.
  • Currently, the privacy commissioner can recommend actions companies can take to comply with privacy legislation, but would need to go to Federal Court to get an enforceable order.

Stoddart also recommends measures to boosting transparency and accountability of companies that gather, store and use Canadians' personal information by requiring companies to:

  • Notify both the privacy commissioner and affected individuals in the case of a privacy breach.
  • Publicly report the number of disclosures of Canadians' personal information they have made to law enforcement agencies and government institutions. PIPEDA allows law enforcement and government agencies to obtain this information without consent.
  • Be accountable for their commitments to improve privacy practices, following an investigation or audit, by being required to demonstrate compliance within a set time period or face consequences.

Voluntary privacy breach reporting 'unacceptable'

In the case of privacy breaches, organizations can currently report breaches voluntarily, but don't have to, a situation that Stoddart called "unacceptable" and "unfair." She noted that organizations that do report breaches often suffer damage to their reputation and costs associated with fixing the problem. "Meanwhile, those that do not report may escape with no negative effects on their reputation or bottom line."

Stoddart has been calling for similar changes for years, but so far the government has not committed to updating PIPEDA.

Man linked to Boston bombing suspect killed by FBI in Florida

ORLANDO, Fla./WASHINGTON (Reuters) - A Chechen immigrant who was being questioned about his possible links to one of the Boston Marathon bombing suspects was shot and killed by a federal agent in Florida on Wednesday after he suddenly turned violent, the FBI said.

A friend of the dead man identified him to Reuters as 27-year-old Ibragim Todashev, who had previously lived in Boston and knew Tamerlan Tsarnaev, the older of the two brothers suspected of planting two bombs at the marathon on April 15, killing three people and injuring 264.

NBC News reported that Todashev had confessed to his involvement in an unsolved 2011 triple homicide in a Boston suburb that investigators believe was drug related, citing law enforcement officials.

Authorities were investigating possible connections between Tsarnaev, who died in a shootout with police, and the 2011 incident.

Three men including a close friend of Tsarnaev were found stabbed in the neck in an apartment on September 12, 2011, in Waltham, Massachusetts. News reports said marijuana was strewn over their bodies.

Wednesday's incident took place at an apartment complex near the Universal Studios theme park, where the FBI and members of other law enforcement agencies were interviewing the man about the marathon bombing.

"A violent confrontation was initiated by the individual," the FBI said. A special agent, it said, "acting on the imminent threat posed by the individual, responded with deadly force. The individual was killed and the special agent was transported to the hospital with non-life-threatening injuries."

The possibility that Tsarnaev was connected to the Waltham murders is "being looked at seriously," said Republican Representative Peter King, who serves on the House Homeland Security Committee. Other U.S. officials confirmed the investigation did involve Tsarnaev's possible role.

Tamerlan Tsarnaev, 26, and his 19-year-old brother Dzhokhar are suspected of setting off two pressure-cooker bombs at the marathon finish line. Dzhokhar is being held at a prison hospital west of Boston awaiting trial on charges that carry the possibility of the death penalty.

'NOTHING TO HIDE'

Todashev knew Tsarnaev because both were mixed martial-arts fighters in Boston but had no connection to the bombing, a friend of Todashev, Khusen Taramov, told Reuters in an interview.

Todashev was tailed by law enforcement agents since the day the Tsarnaev brothers were identified as suspects in the Boston bombing and called in for questioning repeatedly, he said.

"They called him a lot. They would just call and question him," Taramov said, adding he and his friend had met with FBI agents on several occasions.

Asked about the 2011 triple homicide, Taramov said it never came up in the meetings with the FBI that he personally attended. He said Todashev never mentioned the murders either.

"He had nothing to hide. Everything he knew, he told them," Taramov said.

Taramov said he met FBI agents on Tuesday night outside the apartment complex where his friend was killed but was told by the FBI to leave shortly before the shooting happened around midnight. He added that Todashev, who was in the United States as a legal permanent resident, had been planning a trip back to Russia where his parents live.

Law enforcement officials have also interviewed another person of Chechen origin, ex-rebel Musa Khadzhimuratov, at his home in New Hampshire, the New York Times reported last week. Khadzhimuratov, who had served as a bodyguard to a top Chechen separatist leader during the region's civil war with Russia more than a decade ago, also had contact with Tsarnaev.

Neighbors said that in recent weeks, they had noticed what looked like undercover officers in unmarked cars in the parking lot outside the apartment complex where Todashev was shot and killed. Several neighbors said he jogged on the paths through the complex shadow boxing, and sometimes swam laps in the pool and sparred with friends on the pool deck.

Todashev was arrested on May 4 and charged with aggravated battery after getting into a fight with another man over a parking space at an Orlando shopping mall, according to the Orange County Sheriff's Office in Orlando.

The man, who suffered a split upper lip and had several teeth knocked out of place, did not to press charges against Todashev, who was released from jail on a $3,500 bond, a sheriff's spokeswoman said.

Before the Boston bombings, Tamerlan Tsarnaev had been listed on multiple U.S. government databases, including a master list of potential terrorism suspects. U.S. authorities also were asked twice by Russia to investigate Tsarnaev for possible involvement with Islamic militants, U.S. officials have said.

Also, on Wednesday afternoon, U.S. Attorney General Eric Holder was scheduled to meet in Washington with Vladimir Kolokoltsev, Russia's interior minister. The meeting's agenda was unclear, but U.S. investigators are anxious to learn what Russian authorities knew about the Tsarnaevs and about what Tamerlan Tsarnaev did during a six-month trip to Russia last year.
